Chapter 13 - What Really Happened to Elena

Rosa Hernández agreed to speak with investigators two days later.

Not because she had suddenly become brave.

Not because she'd decided to tell the truth for its own sake.

But because Daniel Varela stopped answering her calls.

Then her bank froze several accounts pursuant to legal proceedings.

And the attorney who had spent decades assuring her everything was under control began distancing himself from her.

For the first time, Rosa understood something terrifying.

Daniel had never been protecting her.

He had been protecting himself.

She hired an attorney.

Then gave a recorded statement with counsel present.

Luis was not in the room.

He was at the hospital with Mariana and Sofia.

Mercer later explained the major points Rachel was legally permitted to share.

The story began in 1995.

Rosa had wanted a child desperately.

She and Gabriel had endured years of infertility.

When a coworker mentioned her teenage niece was pregnant, Rosa offered to help.

The girl's name was Elena Morales.

Elena was seventeen.

Her family was wealthy.

But her pregnancy had created a scandal.

Her aunt, Cecilia Morales, wanted the baby placed for adoption.

Elena refused.

She wanted to raise him.

Cecilia contacted Daniel Varela, a young attorney who handled family affairs.

Daniel suggested an arrangement.

Elena would give birth.

Rosa and Gabriel would care for the baby temporarily.

Then Elena could make a decision.

But after Luis was born, the arrangement changed.

Rosa fell in love with the baby.

She refused to return him.

Cecilia wanted the problem gone.

And Daniel saw an opportunity.

He prepared documents making the transfer appear permanent.

A signature purporting to be Elena's appeared on the papers.

Elena always denied signing.

A later forensic examination would raise serious questions about its authenticity.

Gabriel believed the adoption was legitimate.

Rosa knew Elena had objected.

And Daniel knew exactly how the paperwork had been created.

When Elena came looking for Luis, Rosa told her he was living happily.

That she'd only confuse him.

That she should move on.

Elena refused.

She hired lawyers.

Wrote letters.

Visited the house.

Tried to obtain records.

Daniel used his position to delay proceedings and challenge her credibility.

Then Elena's father died.

His estate included a trust for Elena's children.

When the trust administrators learned she had a son, money was designated for Luis.

Daniel offered to manage the matter.

By 2001, Elena had gathered enough documents to challenge the adoption.

She arranged to meet Gabriel.

She believed he would help.

Instead, Daniel and Rosa arrived.

They confronted her in room twelve.

Daniel offered money in exchange for a signed release.

Elena refused.

An argument followed.

Rosa grabbed her.

Elena stumbled into the furniture and suffered a head injury.

Daniel panicked.

He convinced Rosa that if they called police, they could both face serious consequences.

Instead, he took Elena to a private clinic.

He claimed she was confused and needed psychiatric treatment.

Through misleading records and false representations, he kept her under care.

Over time, Elena was transferred between facilities.

Her identity was obscured.

Her letters were intercepted.

And she was told her son had died.

Rosa had been aware.

Not of every transfer.

Not of every treatment decision.

But of enough.

Enough to know Elena was alive.

Enough to know she was asking for her child.

Enough to know the story Rosa told Luis was a lie.

Daniel also controlled the financial trail.

After Luis turned twenty-five, withdrawals appeared under the identity of Gabriel Hernández.

The evidence suggested signatures had been forged and documentation falsified.

Some money went toward legal fees.

Some toward the facilities.

Some into accounts connected to Daniel.

And some had been used by Rosa.

Mercer explained the last point carefully.

“The financial investigation is ongoing. We cannot yet assign every transaction to a particular person.”

Luis nodded.

He was sitting in Rachel's office.

His hands were clenched.

“What about Elena?”

“She's receiving independent legal support.”

“And Daniel?”

“Investigators have obtained warrants and are pursuing charges supported by the evidence.”

Luis stared at the table.

“Is my mother going to prison?”

Mercer paused.

“That will depend on the charges, the evidence, and the courts.”

Luis nodded.

He didn't ask again.

For a long time, he said nothing.

Then Rachel spoke.

“Luis, there's one part of Rosa's statement we need to discuss.”

He looked up.

“What?”

“Your mother said she knew Mariana had found some of the documents.”

“Yes.”

“She admitted confronting her.”

Luis felt his chest tighten.

Rachel continued.

“She admitted taking the car keys.”

His jaw hardened.

“And?”

“She admitted Mariana asked for medical help.”

Luis closed his eyes.

“Three times?”

Rachel nodded.

“Yes.”

Luis turned away.

For days he'd replayed Mariana's words.

You said my baby wasn't your problem.

He had imagined Rosa denying everything.

Claiming a misunderstanding.

Blaming the pregnancy.

Blaming Mariana.

But now the truth was documented.

His wife had asked for help.

His mother had refused.

He opened his eyes.

“Why?”

Rachel hesitated.

“Rosa says she believed Mariana was exaggerating.”

Luis shook his head.

“That isn't enough.”

“No,” Rachel said quietly. “It isn't.”

He looked at her.

“What else?”

Rachel lowered her voice.

“Rosa admitted that she was angry Mariana had found the documents.”

Luis felt cold.

“And?”

“She says she wanted Mariana to stay in the house until they could discuss what she'd discovered.”

Luis stared.

His mother hadn't simply dismissed Mariana's pain.

She had wanted to keep her there.

Not because she thought Mariana was safe.

But because she was afraid Mariana would leave with the evidence.

Luis covered his face.

For a moment, he couldn't breathe.

Rachel waited.

Finally he whispered, “She chose the secret.”

Mercer looked at him.

Luis lowered his hands.

“She chose keeping the secret over helping my wife.”

Neither answered.

He looked toward the window.

Then said something that surprised even him.

“I don't hate her.”

Rachel remained silent.

Luis swallowed.

“I wish I did.”

His eyes filled.

“Because that would be easier.”

Mercer nodded slowly.

“You can love someone and still recognize that what they did was wrong.”

Luis looked down.

“I don't know what I feel.”

“You don't have to decide today.”

He nodded.

Then his phone rang.

Mariana.

He answered immediately.

“Hey, baby.”

Her voice sounded frightened.

“Luis?”

He stood.

“What happened?”

“It's Sofia.”

His heart stopped.

“What?”

“Her oxygen levels dropped. The doctors are with her.”

Luis was already moving.

“I'm coming.”

Mariana began crying.

“Please hurry.”

He ran.

And as he crossed the parking lot, every secret he'd spent days uncovering suddenly became unimportant.

Because the one thing he couldn't bear to lose was happening right now.

His daughter was in trouble.

And there was nothing he could do except get to her.
